Appearance & Testimonial Release

This Appearance & Testimonial Release ("Release") is made between Sugurr LLC, a Wyoming limited liability company ("Sugurr"), and the undersigned participant ("you"), identified by the participation code below.

1. What you are granting

You grant Sugurr a non-exclusive, perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, edit, adapt, subtitle, translate, distribute, publicly display and publicly perform the video(s) you submit under the programme (the "Content"), including your name, likeness, voice, image and the statements you make in the Content, in any media now known or later developed, for advertising, marketing, promotion and related purposes of Sugurr and its products.

2. Editing and disclosure

Sugurr may trim, cut, caption, combine with other material, and otherwise edit the Content, provided the edits do not misrepresent your stated opinion. Where the Content is used in advertising, Sugurr will include a "paid endorsement" or equivalent disclosure in accordance with FTC endorsement guidelines.

3. Your representations

• You are at least 18 years old and have the right to enter this Release.
• The Content is your own genuine opinion based on your actual use of Sugurr for at least 7 days, and contains no claims about experiences you did not have.
• The Content was filmed by you, is your own original footage, and does not include any other person who has not consented to appear, nor any third-party music, images or material.
• You have not been told what to say, and you have disclosed to Sugurr any facts that would make a statement in the Content misleading.

4. Payment

In consideration of this Release, Sugurr will pay you $250 upon receipt of this signed Release (in addition to the $50 submission payment). If Sugurr requests and you deliver three alternate openings and raw footage, Sugurr will pay a further $100. Payment is made via Zelle, Venmo or PayPal to the details on your Gigs dashboard within 10 business days. No other compensation, royalties or residuals are owed for any use of the Content.

5. Non-exclusivity and withdrawal

This Release is non-exclusive: you remain free to post your own copy of the Content or make other videos about Sugurr, including negative ones. Because Sugurr may invest in advertising built on the Content, the license is perpetual and cannot be withdrawn once granted; if you believe the Content has been edited to misrepresent your opinion, contact Sugurr and it will correct or retire that edit.

6. Ownership

You keep copyright in your original footage. Sugurr owns the edited advertisements it creates from the Content. You waive any right to inspect or approve the finished advertisements, and release Sugurr from claims arising from the use of the Content as permitted here, including claims for defamation, invasion of privacy or right of publicity.

7. Independent participant

You are participating as an independent individual, not an employee or agent of Sugurr. You are responsible for any taxes on the payments above. Sugurr may request a completed IRS Form W-9 before payment.

8. General

This Release is governed by the laws of the State of California. It is the entire agreement about the Content and replaces any earlier discussion. It may be signed electronically, and a scanned or photographed signature is as valid as an original.
